Yes x Nothing Phone (2) Postpaid Service Plans Promotion

  1. The Promotion.
    The Yes x Nothing Phone (2) Postpaid Service Plans Promotion (“Promotion”) is a time limited programme launched by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC”). By subscribing and/or using any of the Yes x Nothing Phone (2) Postpaid Service Plans (as defined below) each Yes Subscriber agrees and acknowledges that he/she understands these Promotion T&Cs (as defined below) and agrees to abide by them.
  2. Eligibility.
    The Yes x Nothing Phone (2) Postpaid Service Plans are open for subscription by all Eligible Subscribers as defined in Clause 5.2 hereunder.
  3. Applicable Terms and Conditions.
    Subject only to the variations as expressly set out herein (“Promotion T&Cs”), all other terms and conditions incorporated in the Postpaid Service Terms and Conditions, Postpaid Service Plans Terms and Conditions, Yes Infinite+ Postpaid Service Plan Promotion Terms and Conditions, Yes Infinite Plus (with upfront payment) Service Plans Programme Terms and Conditions, Yes Mobile Number Portability to Infinite Plans Promotion Terms and Conditions and Infinite Supplementary Line Service Plan Terms and Conditions available at yes.my shall remain valid and applicable to this Promotion (collectively referred as “General Applicable Terms and Conditions”). In the event of any inconsistency between the General Applicable Terms and Conditions and the Promotion T&Cs, these Promotion T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to them in the General Applicable Terms and Conditions.
  4. Promotion Period.
    The Promotion commences on 22ndJuly 2023, 08:00 a.m. and continues until further notice. (“Promotion Period”).
  5. Service Offerings
    The service plans offered by YTLC in this Promotion are as detailed in Clause 5.2 hereunder, which shall hereafter be collectively referred to as “Yes x Nothing Phone (2) Postpaid Service Plans”.5.1 Each of the Yes x Nothing Phone (2) Postpaid Service Plan hereunder consists of:
    (a) a Nothing Phone (2) smartphone (“Device”); and
    (b) a 5G-enabled SIM Card (“SIM Card”).

    5.3 Eligible Subscribers may subscribe to any of the Yes x Nothing Phone (2) Postpaid Service Plans provided always that they meet the eligibility criteria and do not have in aggregate, more than fifteen (15) Postpaid Service accounts with YTLC. 

    5.4 When an Eligible Subscriber successfully subscribes to any of the Yes x Nothing Phone (2) Postpaid Service Plan (“Yes Subscriber”), the Yes Subscriber will receive a SIM Card. To enjoy the 5G services, the Yes Subscriber is required to insert the SIM Card into the Device, or any other compatible devices. Please visit www.yes.my/supported-devices/ to determine which devices support the SIM Card.

    5.5 Upon subscription to any of the Yes x Nothing Phone (2) Postpaid Service Plan, the Yes Subscriber is required to perform a one-time activation of the SIM Card within seven (7) days from the date he/she receives the SIM Card (“SIM Activation Period”) under the Yes x Nothing Phone (2) Postpaid Service Plan. In the event a Yes Subscriber fails to activate the SIM Card, after the expiry of the period of seven (7) days mentioned hereinbefore, the SIM Card will automatically be activated.

  6. Infinite Basic Nothing Phone 2 Service Plan
    6.1. Upon successful activation of the Infinite Basic Nothing Phone 2 service plan within the Promotion Period, the Yes Subscriber will be entitled to a RM20 rebate of the Monthly Commitment Fee (“Rebate”) for twelve (12) consecutive Billing Cycles which shall only commence from the month following the SIM Card activation date (“Rebate Period”), provided that the Yes Subscriber’s Service account is not suspended. If the Yes Subscriber’s Service account is suspended in any particular Billing Cycle during the Rebate Period, then the Yes Subscriber will not be entitled to the Rebate. The Yes Subscriber will only be entitled to the Rebate on the next Billing Cycle once the Service account is active.For clarity and avoidance of doubt, a sample illustration is as stated below:
    6.2. Illustration
    In the event the Yes Subscriber’s Service account is suspended for two (2) Billing Cycles from 25th November 2023 through 25th January 2024 (“Suspended Period”), and the Service account is reactivated on 26th January 2024, such Yes Subscriber will not receive any Rebate during the Suspended Period. However, the Eligible Subscriber will continue to enjoy the Rebate for the Billing Cycle from 26th January 2024. Based on the above illustration, the Eligible Subscriber is entitled to the Rebate for twelve (12) Billing Cycles only.

    6.3. If the Yes Subscriber’s Service account is suspended in any particular Billing Cycle during the Rebate Period, then the Rebate will not be carried forward to the next Billing Cycle of such Yes Subscriber. The Rebate will only be given for up to a period of 12 months from the date of SIM activation.

    6.4. Save for the Rebate during the Rebate Period, the Monthly Commitment Fee and other charges will be imposed on any products and/or Services subscribed or used by such Yes Subscriber, including any applicable deposit sum, in accordance with the applicable rates as more specifically stated in YTLC’s official website @ www.yes.my/tnc.

    6.5. After the Rebate Period, the Eligible Subscriber will be charged the Monthly Commitment Fee under the service offering (as stated in the table 1, clause 5.2 herein). However, should the Yes Subscriber choose to terminate the Service within the 1st month, no refund and/or Rebate will be provided.

    6.6 There will be Nothing (2) Launch Editions Set that includes ear (stick), Nothing Phone (2) phone case, adaptor, a one (1) year extended warranty and screen-crack warranty during the first year available only for the first 100 customer who successfully subscribes to and activates a  Yes x Nothing Phone (2) Postpaid Service Plan at Yes Experience Store, Lot 10 on 22nd of July 2023. These Nothing (2) Launch Editions Sets will be given on first come first served basis, subject to stock availability. 

    6.7 For Eligible Subscribers who purchase from other stores/channels besides the Lot 10 Yes Store on 22nd of July 2023, they will receive a Nothing (2) Exclusive Giveaway that includes Nothing Phone (2) phone case, adaptor a (one) 1 year extended warranty and a screen-crack warranty during the first year. These Nothing (2) Exclusive Giveaway will be given on first come first served basis, subject to stock availability.

  7. Alliance Bank Visa Virtual Credit Card Promotion
    In addition to the Yes x Nothing Phone (2) Postpaid Service Plans offered by YTLC under this Promotion, an Eligible Subscriber who applies for an Alliance Virtual Credit Card shall also benefit from the cashback promotion and 0% 12 month instalment plan organized by Alliance Bank Malaysia. Please refer to Alliance Bank Visa Virtual Credit Card & YTL Communications’ Yes Nothing Phone (2) Cashback Campaign Terms and Conditions and Alliance Bank Virtual Credit Card Flexi Payment Plan 0% Interest Terms and Conditions for more information.
  8. Subscription Channels
    An Eligible Subscriber may subscribe to the Yes x Nothing Phone (2) Postpaid Service Plan through Yes Online Store, MyYes app, selected Yes Exclusive Stores and Yes Stores, which are further detailed below;

  9. Warranty.
    The Device provided under the Yes x Nothing Phone (2) Postpaid Service Plan is subject to the Device manufacturer’s standard warranty. Please refer to the manufacturer’s warranty provided with the Device or on the manufacturer’s website to understand the details on protection coverage and duration of the manufacturer’s warranty.   10. Exclusion of liability for use of the Device.
    YTLC shall not be liable to any Eligible Subscriber and/or Yes Subscriber or any person(s) claiming through them for any loss, damages or injury arising from the use or inability to use the Device from any cause whatsoever.
  11. Refund.
    There shall be no refund under the Yes x Nothing Phone (2) Postpaid Service Plan for any reasons whatsoever.
  12. Termination.
    Subject to the termination conditions stipulated in the General Applicable Terms and Conditions, a Yes Subscriber can terminate the Yes x Nothing Phone (2) Postpaid Service Plan subscribed by issuing to YTLC a notice in YTLC prescribed format and supported by all required relevant documents for verification.
  13. Upgrade/Downgrade.
    Yes Subscribers are not allowed to upgrade or downgrade their Yes x Nothing Phone (2) Postpaid Service Plan during the Contract Period.
  14. Early Termination Charges (ETC).
    If a Yes Subscriber terminates his/her Service account or ports out to another service provider at any time before the expiry of the Contract Period or if the Service account is terminated by YTLC as a result of such Eligible Subscriber’s breach of these Yes x Nothing Phone (2) Postpaid Service Plan T&Cs and/or the General T&Cs, such Eligible Subscriber shall be subjected to ETC. Please refer to the General Applicable Terms and Conditions for further details on the ETC.
  15. Limitation of Liability.
    YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Promotion T&Cs.
  16. Laws.
    This Promotion shall be governed by the laws of Malaysia under the jurisdiction of the Malaysian courts.
  17. Modifications.
    YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of the Promotion, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to You or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend the Promotion at any time before or during the Promotion Period with notice but without any liability or compensation whatsoever.
