  1. The Programme.
    \n<\/strong>The Yes Infinite Plus (Foodpanda) Postpaid Service Plan Programme (\u201cProgramme<\/strong>\u201d) is a time limited programme launched by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (\u201cYTLC\u201d) in collaboration with Foodpanda Malaysia Sdn. Bhd. (\u201cFoodpanda\u201d). By Your subscription or use of any of the Yes Infinite Plus (Foodpanda) Postpaid Service Plan (as defined below) You acknowledge that You understand these Programme T&Cs (as defined below) and agree to abide by them.<\/li>\n
  2. Eligibility.
    \n<\/strong>2.1 The Yes Infinite Plus (Foodpanda) Postpaid Service Plan are open to all Malaysians individuals above 18 years and below 65 years of age and in possession of a valid MyKad or MyPR or MyTentera whichever is applicable,\u00a0registered with and verified as Foodpanda Riders by Foodpanda (\u201cEligible Subscribers<\/strong>\u201d).
    \n2.2 Eligible Subscribers will receive an email notification with unique link to purchase the Yes Infinite Plus (Foodpanda) Postpaid Service Plan.<\/li>\n
  3. Applicable Terms and Conditions.
    \n<\/strong>Subject only to the variations as expressly set out herein (\u201cPromotion T&Cs\u201d), all other terms and conditions incorporated in the\u00a0Postpaid Service Terms and Conditions<\/a>,\u00a0Postpaid Service Plans Terms and Conditions<\/a>,\u00a0Yes Infinite+ Postpaid Service Plan Programme Terms and Conditions<\/a>\u00a0and\u00a0Infinite Supplementary Line Service Plan Terms and Conditions<\/a>\u00a0available at\u00a0yes.my<\/a> shall remain valid and applicable to this Yes Infinite Plus (Foodpanda) Postpaid Service Plan Programme (collectively referred as \u201cGeneral Applicable Terms and Conditions<\/strong>\u201d). In the event of any inconsistency between the General Applicable Terms and Conditions and the Programme T&Cs, these Programme T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to them in the General Applicable Terms and Conditions.<\/li>\n
  4. Programme Period.
    \n<\/strong>The Programme commences on 20th<\/sup> February 2023. via Yes Online Store and will continue for such period unless otherwise notified by YTLC (\u201cProgramme Period<\/strong>\u201d).<\/li>\n
  5. Service Offerings<\/strong>
    \n5.1 Each of the Yes Infinite Plus (Foodpanda) Postpaid Service Plan is a Postpaid Service Plan consisting of:
    \n(a) a smartphone (please refer to table offering under clause 5.6 on the type of smartphone provided under the respective Yes Infinite Plus (Foodpanda) Postpaid Service Plan (\u201cDevice<\/strong>\u201d);
    \n(b) 5G-enabled SIM Card; and
    \n(c) RM20 Discount for 36\u00a0months contract period of Monthly Commitment Fee from the date of service activation only (please refer to the Programme T&Cs herein for the other applicable charges).
    \n5.2 Save for the RM20 discount during the Discount Period, the Monthly Commitment Fee and other charges will be imposed on any products and\/or Services subscribed or used by such Eligible Subscriber, including any applicable deposit sum, in accordance with the applicable rates as more specifically stated in Our official website @\u00a0    www.yes.my\/tnc<\/a>.
    \n5.3 After the Discount Period, the Eligible Subscriber will be charged the Monthly Commitment Fee under the service offering (as stated in the table below) and in the event such Eligible Subscriber walk in to Yes Store for termination, he\/she will be subject to\u00a0    Postpaid Service Plan Terms and Conditions<\/a>.
    \n5.4 The discount applies to the Monthly Commitment Fee for a period of thirty six (36) Billing Cycles (\u201cDiscount Period<\/strong>\u201d). After the Discount Period, the Monthly Commitment Fee will be as per respective Monthly Commitment Fee subject to the\u00a0Yes Infinite Plus (Foodpanda) Postpaid Service Plan (hereinafter shall be collectively referred to as the \u201c<\/strong>Yes Infinite Plus (Foodpanda) Postpaid Service Plan<\/strong>\u201d<\/strong>.
    \n5.5 If the Eligible Subscriber\u2019s Service account is suspended in any particular Billing Cycle during the Discount Period, then the RM20 monthly discount will not be carried forward to the next Billing Cycle of such Eligible Subscriber. The RM20 monthly Discount Promotion will only be given for up to a period of 36 months from the date of SIM activation.
    \n5.6 The full details of each of the service offerings under each of the Yes Infinite Plus (Foodpanda) Postpaid Service Plan Programme are:

    5.7 You may subscribe to one or more Yes Infinite Plus (Foodpanda) Postpaid Service Plan provided always that You do not have, in aggregate, more than fifteen (15) Postpaid Service accounts with YTLC.
    \n<\/span>5.8 When You subscribe to any of the Yes Infinite Plus (Foodpanda) Postpaid Service Plan, You will receive a 5G enabled SIM card (\u201c<\/span>SIM Card<\/strong>\u201d). To enjoy the 5G services, You are required to insert the SIM Card into a compatible Device. Please visit\u00a0<\/span>www.yes.my\/supported-devices\/<\/a> to determine which of the Device supports the 5G-enabled SIM Card.
    \n<\/span>5.9 Upon subscription to any of Our Yes Infinite Plus (Foodpanda) Postpaid Service Plan, an Eligible Subscriber is required to perform a one-time activation of the SIM Card within seven (7) days from the date he\/she receives the SIM Card (\u201c<\/span>SIM Activation Period<\/strong>\u201d) under the Yes Infinite Plus (Foodpanda) Postpaid Service Plan. In the event an Eligible Subscriber fails to activate the SIM Card, after the expiry of the period of seven (7) days mentioned hereinbefore, the SIM Card will automatically activate.
    \n<\/span>5.10 The 5G internet speed under the Yes Infinite Plus (Foodpanda) Postpaid Service Plan depends fully on the 5G network coverage in such area and\/or locations.
    \n<\/span>5.11 If You have fully utilised the Hotspot Data Capacity Allocation under the respective Yes Infinite Plus (Foodpanda) Postpaid Service Plan before the expiry of the relevant Billing Cycle, You may purchase a Postpaid Hotspot Add-On to enjoy internet data with no speed control. For purposes of clarity, any mention on speed shall mean the optimum speed which means the actual speed enjoyed by You may vary depending on various other factors including but not limited to technical and environmental factors.
    \n<\/span>5.12 The unlimited On-Net Services of voice calls and SMS, and Off-Net Services of voice calls are exclusive for Your use in Malaysia only and applicable for communications between person-to-person personal use and not commercial use. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using Your SIM Card in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is therefore prohibited.<\/span><\/li>\n

  6. Charges & SST
    \n<\/strong>6.1 Save as expressly provided herein, there will be no additional charges imposed on domestic On-Net Service of voice calls and SMS and domestic Off-Net Service of voice calls. However, the following charges will be imposed on domestic Off-Net Service of SMS:<\/p>\n\n\n\n\n

    6.4 The charges stated in this Clause 6 are exclusive of SST.<\/li>\n

  7. Limitation of Liability.
    \n<\/strong>YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Programme T&Cs.<\/li>\n
  8. Laws.
    \n<\/strong>This Programme shall be governed by the laws of Malaysia under the jurisdiction of the Malaysian courts.<\/li>\n
  9. Modifications.
    \n<\/strong>YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of the Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to You or any other party.
