  1. The Promotion.<\/b>\u00a0The Kasi Up Unlimited and Kasi Up Turbo 5GB Prepaid LTE Data Add-On Promotion (\u201d\u00a0Promotion<\/b>\u201c) is a time-limited promotion by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (\u201cYTLC<\/b>\u201c).<\/li>\n
  2. Eligibility.<\/b>\u00a0This Promotion is open to all Yes Subscribers subscribing to any of the Prepaid Service Plans (\u201cEligible Subscribers<\/b>\u201d) to access and use the Service via smartphones only and not any other devices (including huddles and home wireless modem).<\/li>\n
  3. Terms and Conditions, Interpretations and Definitions.<\/b>
    \n3.1 By participating in this Promotion, each Eligible Subscriber agrees that he\/she has read and understood all the terms and conditions herein (\u201cPromo Terms and Conditions<\/b>\u201c) and agrees to be bound by these Promo Terms and Conditions.
    \n3.2 Subject only to the variations as expressly set out herein, all other terms and conditions relating to the Prepaid Service available @ www.yes.my\/tnc (\u201cPrepaid T&Cs<\/b>\u201d) shall remain and be applicable to this Promotion. In the event of any inconsistency between the Prepaid T&Cs and the Promo Terms and Conditions, these Promo Terms and Conditions shall prevail to the extent of any such inconsistences.
    \n3.3 All capitalised words shall unless otherwise provided, bear the same meanings as defined in this Promo Terms and Conditions or the Prepaid T&Cs.<\/li>\n
  4. Promotion Period.<\/b>\u00a0The Promotion commences on 15th December 2020, 12:00 a.m. until further notice (\u201cPromo Period<\/b>\u201d).<\/li>\n

    The Kasi Up Unlimited and Kasi Up Turbo 5GB shall be collectively referred to as the \u201cKasi Up Prepaid LTE Data Add-On<\/b>\u201c.
    \n5.2 The Kasi Up Turbo 5GB is only available to Eligible Subscribers who have subscribed to the Kasi Up Unlimited. During the Account Validity Period of the Kasi Up Unlimited, an Eligible Subscriber is not entitled to purchase any other Prepaid LTE Data Add-On offered by YTLC except for Kasi Up Turbo 5GB.<\/p>\n

    5.3 (a) Subject to Clause 5.3(b) herein, an Eligible Subscriber is only entitled to subscribe to one (1) Kasi Up Unlimited during the Account Validity Period of the respective Kasi Up Unlimited which means multiple subscription of Kasi Up Unlimited is not allowed.<\/p>\n

    (b) Notwithstanding the provision in Clause 5.3(a) above, an Eligible Subscriber may subscribe to a Kasi Up Unlimited or any Prepaid LTE Data Add-On five (5) days prior to the expiration of his\/her Kasi Up Unlimited Account Validity Period. For clarity and by way of illustration only, if an Eligible Subscriber had subscribed to a Kasi Up Unlimited on 16th March 2020, the Account Validity Period of such Kasi Up Unlimited is until 14th April 2020. The Eligible Subscriber is only entitled to subscribe to a Kasi Up Unlimited (provided that the Promotion is still ongoing), or any other Prepaid LTE Data Add-On, at any time after the 9th April 2020.<\/p>\n

    5.4 In the event an Eligible Subscriber commits a breach of the Promo Terms and Conditions (\u201c\u00a0Defaulter<\/b>\u201d), YTLC reserves the right to throttle the Defaulter\u2019s use of the Service to 256Kbps without prior notice to the Defaulter. A Defaulter will need to subscribe to the \u201cUnthrottle Me Data Add-On\u201d via MyYes app to continue enjoying the Service at unthrottled speed.<\/p>\n

    5.5 In the event an Eligible Subscriber subscribes to the Kasi Up Unlimited during the Account Validity Period of any Prepaid LTE Data Add-On previously subscribed, the data remaining in the Prepaid LTE Data Add-On shall be firstly utilised subject to such Prepaid LTE Data Add-On\u2019s Account Validity Period before utilisation of the internet data in the Kasi Up Unlimited.<\/p>\n

    5.6 Once the internet data of 9GB for the use of hotspot is fully utilised, and Eligible Subscriber will not able to use the hotspot during such Account Validity Period.<\/p>\n

    5.7 Service speeds, if stated, are on best effort basis. Factors such as coverage, location, building interference, distance from communications towers and number of concurrent users may affect the Service speed and Service performance (voice and\/or SMS).<\/p>\n

    5.8 The Yes Rebates is not applicable to this Promotion.<\/li>\n

  6. Limitation of Liability<\/b> YTLC shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Promotion.<\/li>\n
  7. Termination.\u00a0<\/b>The Kasi Up Prepaid LTE Data Add-On purchased by an Eligible Subscriber shall be automatically terminated without any refunds to the Eligible Subscribers upon termination of such Eligible Subscriber\u2019s Service account.<\/li>\n
  8. Laws.<\/b> This Promotion shall in all respects be governed by the laws of Malaysia and by participating in the Promotion, the Eligible Subscribers submits to the exclusive jurisdiction of the courts of Malaysia.<\/li>\n
  9. Modifications.<\/b>\u00a0YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Promotion, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party.
