  1. The Campaign.<\/strong>
    \nThe Yes First To 5G Campaign (\u201cCampaign\u201d<\/strong>) is a campaign organised by YTL Communications Sdn Bhd (Company No.200701035605(793634-V)) (\u201cYTLC\u201d). Under this Campaign, a person who subscribes to a Yes Postpaid FT5G Service Plan (as defined below) or a Yes Prepaid FT5G Service Plan (as defined below) may enjoy unlimited internet data on 5G network (\u201c5G Service\u201d) for a period commencing from the date of subscription of the Yes FT5G Service Plan until further notice, subject to the terms and conditions hereinafter appearing.<\/span><\/li>\n
  2. Eligibility.<\/strong>
    \n2.1 The following postpaid plans (each a \u201cYes Postpaid FT5G Service Plan\u201d) are offered under this Campaign:
    \n<\/span>2.1.1 Yes Postpaid FT5G RM99 Service Plan; and
    \n2.1.2 Yes Postpaid FT5G RM49 Service Plan.
    \n2.2 The following prepaid plans (each a \u201cYes Prepaid FT5G Service Plan\u201d) are offered under this Campaign:
    \n2.2.1 FT5G RM30 Unlimited Service Plan;
    \n2.3 Any person who is:
    \n2.3.1 eighteen (18) years and above may subscribe to the Yes Postpaid FT5G RM99 Service Plan or Yes Postpaid FT5G RM49 Service Plan;
    \n2.3.1 twelve (12) years and above may subscribe to the Yes Prepaid FT5G RM30 Service Plan provided he\/she must not have, in aggregate, more than five (5) prepaid accounts with Yes.<\/li>\n
  3. Applicable Terms & Conditions:<\/strong>
    \nSubject only to the variations as expressly set out herein (\u201cCampaign T&Cs\u201c), all other terms and conditions incorporated in the Postpaid Service Terms and Conditions, Prepaid Service Terms and Conditions, Yes Kasi Up Refer & Earn Programme Terms and Conditions available at www.yes.my\/tnc<\/a> shall remain valid and be applicable to the Promotion (hereinafter collectively referred to as the \u201cGeneral Applicable Terms and Conditions\u201c). In the event of any inconsistency between the General applicable Terms and Conditions and these Campaign T&Cs, these Campaign T&Cs shall prevail to the extent of any such inconsistency.<\/span><\/li>\n

    5.3 If You subscribe to the Yes Postpaid FT5G RM49 Service Plan or Yes Prepaid FT5G RM30 Service Plan, You are required to perform a one-time activation of the SIM Card within thirty (30) days from the date You receipt he SIM Card. Failing to do so will result in automatic SIM Card expiration and Your Service account shall be terminated accordingly. In such instance, any payment made by You, including the Commitment Fee and any deposits paid, shall be automatically forfeited and no refund shall be made to You.
    \n5.4 If You subscribe to Our Yes Postpaid FT5G RM99 Service Plan, You shall perform a one-time activation of the SIM Card within seven (7) days from the date You receipt the SIM Card under the Yes Postpaid FT5G RM99 Service Plan. The SIM Card automatically activates if You have not activated Your SIM Card within the said seven (7) days.
    \n5.5 You may enjoy the service offerings with Uncapped 4G\/5G speed (Data Usage and Speed are subject to relevant 5G or 4G coverage). In relation to the Yes Prepaid FT5G Service Plan, You may purchase the FT5G Data Add-On as specified in clause 6 below.
    \n5.6 Please take note that certain areas may not be under 5G network coverage. In such instance, You will continue to enjoy uninterrupted 4G connectivity on our Yes network.
    \n5.7 The 5G internet speed on any of the Yes Postpaid FT5G Service Plans or Yes Prepaid FT5G Service Plans fully depends on the 5G network coverage in such area.
    \n5.8 The 5G Yes SIM can only be used on certain types of smartphones. As such, please visit www.yes.my\/supported-devices<\/a> to determine which of the smartphones can support the 5G Yes SIM or www.yes.my\/e-sim<\/a>\u00a0for Yes eSIM.
    \n5.9 Please take note that even though Your Service account is suspended during the Contract Period, You shall continue to pay the Monthly Commitment Fee reflected in Your Bill.
    \n5.10 The unlimited voice call or SMS services are exclusive for Your use in Malaysia only and applicable for communications between person-to-person personal use and not commercial use. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using Your Yes SIM in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is therefore prohibited.
    \n5.11 In the event an Eligible Subscriber commits a breach of the Promo Terms and Conditions (\u201c Defaulter\u201d), YTLC reserves the right to throttle the Defaulter\u2019s use of the Service to 256Kbps without prior notice to the Defaulter. A Defaulter will need to subscribe to the \u201cUnthrottle Me Data Add-On\u201d via MyYes app to continue enjoying the Service at unthrottled speed.<\/li>\n

  6. FT5G Data Add-Ons
    \n<\/strong>6.1 If You have purchased a Yes Prepaid FT5G Service Plan, You may at any time purchase a FT5G Data Add-On (each a \u201cFT5G Data Add-On\u201d) provided that You are within the Account Validity Period. For further details on the service offerings under the FT5G Data Add-On, please refer to clause 6.2 below.

Thereafter, and provided that the Data Add-on validity period has not expired, You may subscribe to any of the Data Add-On which is made available by Us for Your purchase.<\/li>\n

  7. Limitation of Liability.
    \n<\/strong>YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Yes First To 5G Campaign.\u00a0<\/span><\/li>\n
  8. Laws.
    \n<\/strong>This Yes First To 5G Campaign shall in all respect be governed by the laws of Malaysia.\u00a0<\/span><\/li>\n
  9. Modifications.
    \n<\/strong>YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Yes First To 5G Campaign, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to You or any other party.
