Kasi Up Unlimited Data and Voice Add-On Promotion

  1. The Promotion. The Kasi Up Unlimited Data and Voice Add-On (“Kasi Up Unlimited Data and Voice”) Promotion (”Promotion“) is a time-limited promotion by YTL Communications Sdn Bhd (Company No. 200701035605 (793634-V)) (“YTLC“).
  2. Eligibility. This Promotion is open to all YES Prepaid Subscribers (“Eligible Subscribers”) to access and use the Service via smartphones only and not any other devices (including huddles and home wireless modem).
  3. Terms and Conditions, Interpretations and Definitions.
    3.1 By participating in this Promotion, each Eligible Subscriber agrees that he/she has read and understood all the terms and conditions herein (“Promo Terms and Conditions“) and agrees to be bound by these Promo Terms and Conditions.
    3.2 Subject only to the variations as expressly set out herein, all other terms and conditions relating to the Prepaid Service Terms and Conditions available @ www.yes.my/tnc (“General Applicable Terms and Conditions”) shall remain and be applicable to this Promotion. In the event of any inconsistency between the General Applicable Terms and Conditions and these Promo Terms and Conditions, these Promo Terms and Conditions shall prevail to the extent of any such inconsistences.
    3.3 All capitalised words shall unless otherwise defined herein, bear the same meanings as defined in the General Applicable Terms and Conditions.
  4. Promotion Period. The Promotion commences on 16th April 2022, 12:00 a.m. until further notice (“Promo Period”).
  5. Promotion Description.
    The following preloaded data add-on packs are offered under this Promotion:-

    5.2 An Eligible Subscriber may purchase Kasi Up Unlimited Data and Voice via any of the following channel namely:-
    (a) Authorised Yes Dealer.

    (b) MyYes app.

    (c) Yes Store

    5.3 (a) Subject to Clause 5.3(b) herein, an Eligible Subscriber is only entitled to subscribe to one (1) Kasi Up Unlimited Data and Voice during the Account Validity Period of the respective Kasi Up Unlimited Data and Voice which means multiple subscription of Kasi Up Unlimited Data and Voice is not allowed.

    (b) Notwithstanding the provision in Clause 5.3(a) above, an Eligible Subscriber may subscribe to a Kasi Up Unlimited Data and Voice Add-On five (5) days prior to the expiration of his/her Kasi Up Unlimited Data and Voice Account Validity Period. For clarity and by way of illustration only, if an Eligible Subscriber had subscribed to a Kasi Up Unlimited Data and Voice on 16th May 2022, the Account Validity Period of such Kasi Up Unlimited Data and Voice is until 14th Jun 2022. The Eligible Subscriber is only entitled to subscribe to a Kasi Up Unlimited Data and Voice(provided that the Promotion is still ongoing)  at any time after the 9th Jun 2022.

    5.4 In the event an Eligible Subscriber commits a breach of the Promo Terms and Conditions (“Defaulter”), YTLC reserves the right to throttle the Defaulter’s use of the Service to 256Kbps without prior notice to the Defaulter. A Defaulter will need to subscribe to the “Unthrottle Me Data Add-On” via MyYes app to continue enjoying the Service at unthrottled speed.

    5.5 In the event an Eligible Subscriber subscribes to the Kasi Up Unlimited Data and Voice during the Account Validity Period of any Prepaid LTE Data Add-On previously subscribed, the data remaining in the Prepaid LTE Data Add-On shall be firstly utilised subject to such Prepaid LTE Data Add-On’s Account Validity Period before utilisation of the internet data in the Kasi Up Unlimited Data and Voice.

    5.6 Once the internet data of 9GB for the use of hotspot is fully utilised, and Eligible Subscriber will not able to use the hotspot during such Account Validity Period.

    5.7 Service speeds, if stated, are on best effort basis. Factors such as coverage, location, building interference, distance from communications towers and number of concurrent users may affect the Service speed and Service performance (voice and/or SMS).

    5.8 The Yes Rebates is not applicable to this Promotion.

    5.9 The unlimited voice call or SMS services are exclusive for Eligible Subscriber’s use in Malaysia only and applicable for communications between person-to-person personal use and not commercial use. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using Eligible Subscriber’s SIM Card in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is prohibited.

  6. Limitation of Liability. YTLC shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Promotion.
