Yes FT5G x NCT Dream Prepaid Plan SIM Pack

  1. The Programme.
    The Yes FT5G x NCT Dream Prepaid Plan SIM Pack Programme (“Programme”) is a time-limited programme launched by YTL Communications Sdn Bhd (Company No.200701035605 (793634-V)) (“YTLC”).
  2. Eligibility.
    The Programme is open to all Malaysians and non-Malaysians residing in Malaysia aged 12 years and above with 5G smartphone (“Eligible Subscribers”). (Please visit www.yes.my/supported-devices/ to determine which of the smartphones can support the 5G-enabled SIM Card.)
  3. Applicable Terms & Conditions:
    Subject only to the variations as expressly set out herein (“Programme T&Cs”), all other terms and conditions incorporated in the Prepaid Service Terms and Conditions, Yes 4G LTE Prepaid Plan Terms and Conditions, Prepaid Kasi Up LTE SIM Plan Terms and Conditions, Prepaid Data Add-On Terms and Conditions, Prepaid Hotspot Add-On Terms and Conditions and Yes First To 5G Campaign Terms and Conditions available at yes.my/tnc (collectively referred as “General Applicable Terms and Conditions”) shall remain valid and applicable to this Programme. In the event of any inconsistency between the General Applicable Terms and Conditions and these Programme T&Cs, these Programme T&Cs shall prevail to the extent of any such inconsistency. Words in capital not defined herein shall have the same meaning ascribed to in the General Applicable Terms and Conditions.
  4. Programme Period.
    This Programme will commence on 10th April 2023, 12:00 a.m. and will continue for such period unless otherwise notified by YTLC (“Programme Period”).
  5. Application for Yes FT5G x NCT Dream Prepaid Plan SIM Pack.
    5.1 Application for the Yes FT5G x NCT Dream Prepaid Plan SIM Pack may be made via any of the following channels only namely:-
    (a) www.yes.my;
    (b) Yes Store;
    (c) Shopee.
    5.2 Each Yes FT5G x NCT Dream Prepaid Plan SIM Pack consists of one (1) 5G-enabled SIM Card and a Yes Mobile Number.
  6. The Programme.
    6.1 The Service offering under the Yes FT5G x NCT Dream Prepaid Plan SIM Pack are as stated below:-

    6.1.1 There are two (2) Add-Ons available under the Yes FT5G x NCT Dream Prepaid Plan SIM Pack. The details of the Add-Ons are as stated below:

    a) Yes FT5G x NCT Dream Prepaid Data Add-On

    6.2 A Subscriber of the Yes FT5G x NCT Dream Prepaid Plan SIM Pack may enjoy the service offerings with uncapped 4G/5G speed (Internet speed will vary depending on whether You are in 5G or 4G coverage) during the Service Validity Period. After the Service Validity Period, such Subscriber may purchase the Yes FT5G x NCT Dream Prepaid Plan Data Add-On or Hotspot Add-On (as the case may be) as specified in the Prepaid Data Add-On Terms and Conditions or the Prepaid Hotspot Add-On Terms and Conditions (as applicable).
    6.3 Each Eligible Subscriber is entitled to register up to five (5) Yes FT5G x NCT Dream Prepaid Plan SIM Pack only provided that the Eligible Subscriber does not have, in aggregate, more than five (5) prepaid service accounts with Yes.
    6.4 Upon receipt of the SIM Card, the Eligible Subscriber is required to perform a one-time activation of the SIM Card within a period of thirty (30) days from the date of receipt of the SIM Card, failing which the SIM Card can no longer be activated and no replacement SIM Card will be provided.
    6.5 A Subscriber of the Yes FT5G x NCT Dream Prepaid Plan SIM Pack may enjoy the service offerings with uncapped 4G/5G speed (Data Usage and Speed are subject to relevant 5G or 4G coverage). Such Subscriber may also purchase the FT5G Data Add-On as specified in Clause 6 of the Yes First To 5G Campaign Terms and Conditions.
    6.6 Please take note that certain areas may not be within 5G network coverage. In such instance, a Subscriber of the Yes FT5G x NCT Dream Prepaid Plan SIM Pack will continue to enjoy uninterrupted 4G connectivity on our Yes network.
    6.7 The 5G internet speed on the Yes FT5G x NCT Dream Prepaid Plan SIM Pack fully depends on the 5G network coverage in such area.
    6.8 The 5G-enabled SIM Card can only be used on certain types of smartphones. As such, please visit www.yes.my/supported-devices/ to determine which of the smartphones can support the 5G-enabled SIM Card.
    6.9 The unlimited On-Net Services are exclusive for Your use in Malaysia only and applicable for communications between person-to-person personal use and not commercial use. Therefore, conference calling, re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, continuously call forwarding, auto-dialling, machine-to-machine communication (including by using Your SIM Card in any other devices), Cellular Trunking Units (CTUs), or any other activities are considered non-standard usage and is therefore prohibited.
    6.10 In the event an Eligible Subscriber commits a breach of the Promo Terms and Conditions (“Defaulter”), YTLC reserves the right to throttle the Defaulter’s use of the Service to 256kbps without prior notice to the Defaulter. A Defaulter will need to subscribe to the “Unthrottle Me Data Add-On” via MyYes app to continue enjoying the Service at unthrottled speed.

    6.11 Charges & SST
    6.11.1 Save as expressly provided herein, there will be no additional charges imposed on domestic On-Net Service of voice calls and SMS and domestic Off-Net Service of voice calls. However, the following charges will be imposed on domestic Off-Net Service of SMS:

    6.11.2 Charges will be imposed on Eligible Subscriber’s use of all IDD Service in accordance with the voice calls and SMS rates published @ www.yes.my/roaming/
    6.11.3 For clarity, charges will apply for voice calls to special and toll free numbers, including but not limited to those numbers listed below:-

  7. Limitation of Liability.
    YTLC shall not be liable for any loss or damage (including without limitation loss of use, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this Programme.
  8. Laws.
    This Programme shall in all respect be governed by the laws of Malaysia.
  9. Modifications.
    YTLC reserves the right to, at any time, add to, delete, vary or amend the terms and conditions herein or change or modify any aspect of this Programme, in whole or in part at any time and from time to time and at its sole discretion without notice and without liability to the Eligible Subscribers or any other party. Without prejudice to the aforesaid, YTLC reserves the right to cancel, terminate or suspend this Programme at any time before or during the Programme Period with notice but without any liability or compensation whatsoever.
